Welcome to Sumstory’s Terms of Service (the “TOS”). These TOS set out the legal basis for your use of Sumstory's services, and we want you to know your and our rights before you use the Sumstory website or Services.

Please be aware that if you subscribe to our services for a term (the “Initial Term”), the terms of your subscription may be automatically renewed for additional periods of the same duration, unless you cancel your subscription in accordance with Section 10 below.

(hereinafter referred to as “Sumstory”) operates a platform for summarizing and transforming key insights of various content on the internet portal http://sumstory.appand other websites, as well as on mobile applications (a.k.a. Apps, hereinafter referred to as “Platform”). Sumstory’s authors transform the key insights of books, articles, and other content into a concise format. This gives you the opportunity to discover new knowledge by delivering key insights directly to your computer or mobile device. In addition, you have the possibility to purchase content on the Platform for download into your Sumstory account library.

The use of the Platform shall be subject to the following TOS in the version valid at the time of your registration or order, or as amended from time to time in accordance with Section 14. Sumstory does not accept any deviating general terms and conditions from you unless Sumstory agrees to their validity in writing.

These TOS, together with the specific information provided as part of the registration (see Section 3), when ordering a paid subscription (Section 4), and/or other individual content (see Section 6), constitute the complete user contract. The provided information is saved by Sumstory and is available in your user account at any time.

You accept the validity and applicability of these TOS when registering, purchasing a paid subscription, or individual content pieces, as the case may be.

These TOS also apply, with a few exceptions explained in detail in each case, if you have been granted your Sumstory account by your employer (in this case you have a ”B2B License”).

1. Object and Validity of these TOS

Sumstory provides a platform where users can access summaries and key insights from various types of content, including books and articles, in text and audio formats. The use of the Platform is subject to the following terms and conditions.

2. Sumstory’s Services and Rights

Sumstory provides key insights and summaries from books, articles, and other content (the “Platform Content”), allowing you to grasp their essence within a few minutes. Additionally, Sumstory may provide a personal profile, which you can customize with your preferred platform content and organize into categories and lists. Subject to availability, you can purchase additional content on the Platform.

The extent of Platform Content and available options (the “License”) depend on the type of account you selected. Differences exist between a free account (see Section 3), a paid subscription (see Section 4), a free trial (see Section 5), and a purchase of individual content (see Section 6). The license duration is limited to the subscription validity period. For individual content purchases, availability in your account will be unlimited (subject to Section 6).

Rights to Sumstory's services and content remain with Sumstory and/or Sumstory's licensors. Platform Content is typically protected by copyrights and may not be redistributed by you. Sumstory grants you a non-exclusive, time-limited right to personal use of the services and content. You must adhere to our Acceptable Use Policy, found here.

All Sumstory trademarks, trade names, logos, domain names, and other distinctive features are the property of Sumstory. The license does not grant you rights to use Sumstory trademarks or distinctive features for commercial or non-commercial purposes.

3. Registering with Sumstory

To use Sumstory’s services, registration is required. Individuals over the age of 18 may register. Minors aged 14-17 may register with parental consent. Sumstory may require proof of identity or consent.

Registration is free of charge (“Basic Account”) and does not require a paid subscription. By registering, you enter an agreement with Sumstory for limited, free use of the Platform. If your Sumstory account is provided by your employer, registration via the option communicated by your employer grants immediate access to the content covered by your employer's contract with Sumstory.

You can register using your email address and a password, or via a single sign-on service (e.g., Google login). Registration can be completed through our website or mobile apps.

Registration information must be complete, correct, and kept up-to-date. The password must be kept confidential and is solely your responsibility. Any unauthorized use of your account should be reported to Sumstory immediately.

4. Executing an Agreement for a Paid Subscription

To fully benefit from Sumstory's services, you can purchase a paid subscription (“Subscription Access”) for different durations, visible in the order options.

Sumstory's Subscription Access allows you to access additional content and features through our mobile and web-based applications. The Sumstory Premium package includes access to our entire library and premium features.

If you receive Sumstory access through your employer, you generally have access to the Sumstory Premium package, though there may be individual agreements with your employer.

To purchase a Sumstory Premium subscription via our website, complete the online order form and click “Subscribe now.” The contract is concluded when Sumstory sends an acceptance notice (order confirmation) by email. If purchased through an app, you'll receive a receipt confirmation from the app store and a separate order confirmation email from Sumstory.

You can also subscribe via in-app purchase through iOS or Android apps, where you'll need to confirm the purchase in the app store. You'll receive a receipt confirmation from the app store, not directly from Sumstory.

5. Trials/ Testing Phases

Sumstory occasionally offers free trials (“Trial”) to new users. Eligibility for a Trial is at Sumstory's discretion, and Sumstory may discontinue or change a free Trial without notice.

Participation in certain Trials may require entering payment details, with your consent that free access will convert to a paid subscription following the Trial. Subscriptions renew on a recurring basis and can be terminated up to one day before the end of the subscription period. You'll be informed of this process before subscribing to the Trial.

To avoid charges, you must cancel before the Trial ends (via Account Settings or app store settings). Sumstory offers a 14-day money-back guarantee for subscriptions purchased via our website, but we cannot guarantee refunds for in-app purchases.

6. Individual Purchase of Content

You may also purchase additional, individual content to test our offerings without purchasing a full subscription.

To make an individual content purchase, complete the online order form and click “Buy now.” The contract is concluded when Sumstory sends an acceptance notice (order confirmation) by email.

Upon purchase, Sumstory grants you a non-exclusive, non-transferable, non-assignable, non-sublicensable license to download the content to your Sumstory Library for personal, non-commercial use. You may not alter, sell, transfer, or commercially exploit the content.

7. Cancellation Policy

If you are a consumer, you have the right to withdraw from the contract within 14 days without giving any reason. To exercise the right of withdrawal, inform Sumstory of your decision by an unequivocal statement (e.g., letter, fax, or email).

Effects of withdrawal: Sumstory will reimburse all payments received from you, including delivery costs, without undue delay and within 14 days of receiving your withdrawal notice. The reimbursement will use the same payment method you used, unless otherwise agreed.

The right of withdrawal expires for individual content contracts if you have downloaded the content with your consent before the withdrawal period ends.

8. Reimbursement and Payment Methods, Compensation and Retention Rights

The Premium Access is subject to a fee, payable at the beginning of the premium access. Individual content purchases are also subject to payment. If your Sumstory account is provided by your employer, your Subscription Access is generally free, but additional individual content purchases may not be covered.

Sumstory offers payment methods like credit card and PayPal, and additional methods specified at the order process start. You can also use a Sumstory Gift Card.

When purchasing via iOS or Android apps, payment is processed through Apple or Google's in-app purchase process.

You are not entitled to offset claims against Sumstory unless legally or contractually justified. You may only exercise retention rights if your counterclaim arises from the same agreement.

9. Third Party Links and Advertising

The Service may contain links to third-party websites, services, or content. Sumstory does not endorse or assume responsibility for third-party content. Use of third-party websites or services is at your own risk, and Sumstory's TOS and Privacy Policy do not apply.

Sumstory may display promotional information. Paid services may include content developed with other companies.

10. Term and Cancellation

Basic Account Term: Starts upon registration and runs indefinitely. You may cancel at any time via the "Settings" menu in our web app.

Paid Subscription Term for Consumers in Germany: Runs for the selected term (“Initial Term”) and renews indefinitely unless canceled 24 hours before
